ALLEGED BREACH OF AGREEMENT
PRAGNELL v. SMITH
A claim for damages arising out of the alleged breach of an agreement between William Pvagnell, Masterton, and John David Smith, of Carterton, was heard l:efore Mr L. G. Reid, S.M., at the Magistrate's Court, at Masterton, yesterday. Mr P. L. Rollings appeared for plaintiff, and Mr C. A. Pownall for defendant.
The statement of claim was to the effect that on Novemter 27th plaintiff agreed to lease to defendant part of sections 22 and 24, Masterton, and that defendant agreed to deliver up the building at the end of the lease in good repair. It was alleged that defendant or his assignees removed the veather-boarding, partitions, floor, rails, and feeding boxea from a stable belonging to plaintiff, and erected on the said land and did not at tlie expiration of the lease reinstate the building, wherefore plaintiff claimed the &um of £0 6s for alleged breach of agreement, or, in the alternative, £9 6s as damages in respect of the alleged breach.^ After hearing evidence, Bis Worship gave judgment for the plaintiff for £5, wih £3 14s costs.
