CHRISTCHURCH, Last Night
In the Supreme Court this morning, Mr Justice Sim sentenced James Girdwood McKenzie, charged with theft of moneys from the State Fire Office. Sentence had been deferred to allow the judge to look into the authorities on the question of probation. His Honor said that in the case of Rex v. Fowler, Mr Justice Cooper had laid it down that the First Offenders' Probation Act should be administered on some settled principle. Where an offender abused his position of trust on more than one occasion probation could not be granted. In Rex v. Clark, quoted by counsel, Mr Justice Chapman had allowed probation to a Road Board officer because the thefts had. been due to drink, and there had been no criminal intent.
