The proposals contained in the Bill of the Attorney-General, which deals with the by-laws of local authorities, will commend themselves to those charged with the adminisrra tion of local government throughout the Dominion. No problem has been more difficult of solution than that of framing by-laws which will defy the coach and horses which the legal fraternity are so eager to drive through them. Nothing has been more annoying to administrative officers or more prolific of litigation than the by-laws made for the good local government of the people. Not even the ingenuity of the trained legal mind has been sufficient to produce a set of by-laws which will stand the test of a law case. The great difficulty has been to avoid technical error?, and, in nearly every case that has been brought before the Court, the objections raised and sustained against the by-laws have been purely technical. The Bill introduced by Dr. Findlav provides that, on a certificate being given by the Minister within twelve months of the confirmation of by-laws, technicalities such as failure to advertise, or to irregularly minute, will be waived. A point for consideration in this connection is that a great many local authorities have had their by-laws confirmed for Eome years. The Legislature will be doing good service for the country if it succeeds in framing a law which will prevent local bodies being exploited by those who defend their breaches of well-intended and highly-necessary regulations on purely technical grounds.
