CLAIM FOR PROFESSIONAL SERVICES.
JUDGMENT RESERVED,
A claim for professional services was heard at a civil sitting of the Magistrate's Court yesterday morning, when Charles Aylmer Pownall claimed to recover from Martin Kerins the sum of £6 13s 2d alleged to be due in connection with the preparation of a mortgage over defendant's property at Akura. Mr Pownall conducted his own case, and defendant was represented by Mr G. H. Cullen. In support of an application for a nonsuit counsel for defendant argued that the bill was not in conformity with the Law Practitioners' Act, but Mr C. C. Grah- ■ am, the presiding Magistrate, negatived the point raised. Evidence was then given by plaintiff as to the preparation of the mortgage over defendant's property, on the instruction of Mr Tabuteau. It transpired subsequently that defendant did not hold a title to the land. Plaintiff called aa witnesses C. A. Tabuteau, W. Sellar and G. C. Summerell, who deposed as to having either heard Kerins give instructions to have the mortgage prepared or to having acted under defendant's instructions. Defendant in his evidence denied that he had given definite instructions to Sellar, alleging that he simply informed Sellar that he could have the mortgage executed if he liked on a commission basis. Evidence was also given by J. B. Keith, and at the conclusion of the hearing his Worship said that he would reserve judgment in order to go further into th« evidence.
