The Court'of Appeal has dismissed Lieutenant Woods' action, claiming £7,500 damages from the Army Council for his removal from the Grenadier Guards.
The Court characterisedjthe action as frivolous and vexa';ious.
About a year and a half ago Lieutenant Woods was required to resign his commission in the Grenadier Guards, after an enquiry by the Army Council. Lieutenant Woods complained that he was boycotted by his brother officers because of his studious habits, and that pressure was brought on him by them to induce him to resign. The Army Council found that he was unfitted to command men, and his resignation followed. The lieutenant brought an action against the Army Council for unlawfully removing him from the army, .claiming heavy damages.
