ALLEGED ASSAULT.
DANNEVIRKE, May 21. At a previous sitting of the Court hare the Magistrate reserved his decision in the case in which Walter Mends, barman at the Masonic Hotel, was charged with assaulting Peter Hemingsen, and dislocating The evidence showed that Hemingsen went into the hotei and asked for a drink. The publican considered that he was not fit to be server', and refused him. Hemingsen became abusive, and refused to leave the premise's, and when the barman went to call the police' he assaulted him with a stick. The barman wrenched the stick away, and Hemingsen threw himself on the floor and refused to move. Hemingsen stated that he got up and went out and reported to the police that he sustained a dislocated elbow.
To-day the Magistrate delivered his reserved judgment, holding that the licensee was bound to remove a disorderly and abusive man, ar,d that no undue violence' had been used. The rlaimjor £72 damages was dismissed.
