(for tbr.ee years Patrick's* casa 'was argued before the Court of Appeal, and in Maroh, 1905, the sentence was confirmed. An application was then made for a re-argu-ment, but the court declined to reopen the oase. Accused's counsel nest appealed to a single judge for •a new trial on the ground of newlydiscovered evidence. This was also refused.
