Mr Kettle, S.M., gave judgment for defendant, t to-day, in the case against Richard Turner, auctioneer, obarged with bavlng exposed unripe fruit for sale, holding that defendanfc'bad proved that it was not Intended to sell tbe unsound fruit far human consumption, but leaving the purchaser to separate the unsound from the sound fruit after the sale. This method was adopted l:e----aause it was most convenient.
