Hutchisons v. Lancaster. — Claim of £193, balance of account. Mr. Copland for plaintiffs; Mr. M'Coy for the defendant. The defendant put in a set-off in excess of the demand, and claimed to recover the difference some £18. The case was one of account, the evidence being veiy conflicting. The gist of the case was a matter of £27, which the defendant said had been satisfied, and for which he produced a receipt, 'but which the plaintiff said had never been paid or satisfied, alleging that Mr. Mouat, in drawing up a bill of sale for the parties had undertaken to deduct the amount from the bill of sale after execution (as they were in a hurry at the time of signing), but before registration, but had not done so. This was flatly denied by the' defendant. — Verdict for the defendant, with costs of Court, 75., and professional costs £5 sb.
