WARDEN'S COURT, ROXBURGH.

(Before W. L. Simpson, Esq., Warden.) Tuesday, 20th October. J. A. Grant applied for a lease of land unsurveyed, for agricultural purposes, adjacent to section 16, block 1., Benger district. E. Tnbman objected on the ground that the notices were not duly posted, and that the applicant was a dummy for Mr. Kitching. Mr. Kitto objected that the ground was auriferous. Mr. McCarthy objected on general grounds. The applicant put himself in the box and swore that he had duly posted the notices, and seen them, once after posting, ' but declined to Swear that they had been maintained throughout three weeks . He swore positively that he had no communication with or instructions from Mr. Etching in reference to applying for land. He intended to occupy the land as a reserve, and to erect a cottage thereon. In cross-examinition he swore positively the notices had been duly posted, and unless maliciously destroyed should be there yet. Mr. M'Coy, who appeared for Mr Tubman, put that gentleman in the witness box, who swore that he had seen no notices. In crossexamination he admitted he had looked for none until after seeing the advertisement in the "Dunstan Times." Had applied for the same land. Robert Tubman corroborated previous witness' testimony, and made the same admissions in cross-examination. M. McCarthy swore ho was a settler. He saw no notices. Had applied to the Warden's Court when previously in the district. "Mr. Simpson stated that this wa/i incorrect, but witness persisted in his statement. Incross-examination applicant endeavoured to show that M'Cartny bad an animus against him (applicant), but M'Carthy stren- < uously denied this and also denied using threatening language as to complete destruction of Moa Flat run and all connected with it. i Mr. Simpson stated that he saw how injurious it was to interfere with surveyor's reserves. Mr. Waugh had got his section, and he regretted it, but now he refused all I such, applications. Mr. Grant's application, was dismissed, and Tubman need not bring his forward. He should reserve the land altogether.
