(Before E. H. Carew, Esq., Warden.) Wednesday, 25th February.

Mullen <Si Others v. Mackenzie & Another. — This was a claim for £20, damages done to tbe claim of the plaintiffs by tbe defendants leading a water race through it ; and also to bave the certificate of tbe extension of tbe race cancelled, as it bad been obtained without the plaintiff's having notice. Mr. Mouat for tbe plaintiffs. Evidence was given by both sides, from which it appeared that the plaintiffs had not received notice of the application for the extension of the race which caused tbe damage they complained of ; but on tbe other band tbey bad not maintained all tbeir pegs, and tbe defendants ■ wore unaware tbey were tresspassing. His Worship said that he did not feel inclined to cancel tbe certificate, but would visit tbe ground* Tbe case was then adjourned for that purpose. Alexander Campbell appUed for a residence area near Darton's. Adjourned tbat bis Worship might view the ground.

Wm. Thomas, John Kitto, and William Hore, of Munros Gully, applied for a dam. Granted.

Ah Chow, Ah Mou, Ah You, Ah Lye, and Ah Sing applied for leave to divert the Tuapeka river. Granted.

Objected to by John Ross, Hugh Ross, and Finlay Munro (by Mr. M'Coy) on tbe ground that a road was required through it. Granted subject to tbe road, to be resurvcyed so as to allow of road up present track through the section at applicants expense.
