WARDEN'S COURT, ROXBURGH.
(Before W. L. Simpson, Esq., Warden and R.M.) i Tuesday. 23rd Sept. Thia Court is only held once a month. Mr. Borton having resigned, the Government have not thought fit to appoint a i Resident Magistrate for Roxburgh. Complaints are numerous from all quarters about the change, and there can be no doubt the inconvenience caused thereby in many cases is very great. The businesp occupied Mr. Simpson, the whole of a long day, and though his decisions gave great satisfaction as a rule, several parties concerned complained of the cases being hurried through. Mr. Simpson can be hardly expected to know the affairs of the district so well as a Resident Warden. We have no doubt the Government will before long see fit to appoint a Warden to the Teviot district. The first civil case that occupied the Court was f Shubartv Richards. — The plaintiff, who has for some time been practicing at the Teviot aa a medical man, sued the defendant for the sum of £5 ISs.j professional fees and medicine. Defendant declined to pay on the ground that plaintiff,- not being a properly qualitiud practitioner, had no right to chargu, His Worship gave judgment for defendant, commenting severely on the plaintiffs conduct, who on being asked could not produce a diploma or certificate of any kind, although he had been advertising himself as an M.D. • The next case that occupied the Court was • Low and Company v. Ayling. — The plaintiffs submitted that they lent a chaffcutter to defendant, who broke it, and although he repaired it, they did not consider it done to their satisfaction. They would not take delivery of it on thai account. His Worship found for defendant, hd having used ordinary care, and had got the machine repaired in a workmanlike manner. Several' applications for agricultural leases, extended claims, residence areas, &c. , occupied the Court up till a late hour of the day.
