The boundary line described on lease "towards the N..W by part of sec. 12, 461 links," is from 16 to 85. The figures on the line are 35.30 deg. and 3G1.3 links. In answer to Mr Barton, the witness said he did not show the plin to Morrison before : ho sent down the lease. Mr. Barton objected to the witness explaining the deed. Re-exaininatio n continued — The N. E. boundary described in tha lease "bounded towards the N.E. bounday, 235 links " " is the line from 12 to 85 on the map. Mr. Barton again objected to the witness explaining. Witness —On the plan produced, the figure to the left represents plaintiffs' claim, according to the bearings and distances on the lease, assuming the true meridian was used. The figure to the right represents the plaintiffs' claim as surveyed by me. There is a difference in position between the two positions of 10 to 15 chains. (Witness showed by Drumuiond's plan.and tracing of his own, plon the difference in, the position of plaintiffs' claim »s described by Drummond and surveyed by himself. ) The effect of mysurvey is to give the plaintiffs* a greater area on the north and on the south. (Explained tracing on map to judge and jury. ) On my first visit I believe the surface at peg 85 was; gone. From the appearance of the ground, I believe it had been worked. If was of a reddish color. "These workings appeared, tohave been lower than the surface. I don't think at that time the stability of the ground was affected. Oa my second visit the ground, appeared soft. The partnership of defendants was ad-, mitted. This closed plaintiffs' case. Mr. Macassey said that an* arrangementhad been arrived at between- himself and his. learned friend Mr. Barton, by which thearguments- on points raised were to be reserved for the Court in banco, and would be. only mentioned at present. Mr. Barton raised several nonsuit points, and opened* the case for defendants. Hisspeech lasted till a quarter to four, at whichi time the Court adjourned till Saturday..
