Every act which 1 the 1 Superintendent' is authorised or required' to perform; by the terms of! the AcVhe shall .perform solelyin accordance-with.the .advice of his Executive Council .for, toe time being,, and, such advice shall be. recorded 'on the minutes 'of the Executive Council. WASTE LANDS, .BQABD CONSTITUTED.r POWEBS J)EFINED. There shall be a Board of CJorajnKf,sioners to be called "The Waste Lands, Board of t(ie province of CXtagd,"( a"nd the said Board' shall' consist of one Chief Commissionerj and of riot' less than two nor more .th'atn five other Commissioners, all of whom shall be appointed and"bn removable by warrant under hand of the. Superintenaent J, subject to the approval of.the G-over-lior 'in Conuoil. Provided that, not moro than one member of the Executive Council shall be a member of the Board. • The salaries of the Commissionerer, except that of the 'Commissioner of Crown Lands, and of the officers of the Board appointed By the Superintendent or by the Board, shall be paid out of revenues appropriated Toy the purpose by the Provincial Council. The Board shall have an office in Dimedin, at which office the Board shall sit. The Commissioner of Crown Lands, when present, and in his absence then some member selected by those present at any meeting of the Board, shall preside thereat, and the Chairman shall have an original as well as a casting vote in all questions coming before the Board. Allquestions coming beforethe Board shall be decided by a majority of the Commissioners present. All meetings of the Board shall be attended by at leasL three Commissioners, and shall be open to the public. The Eoitrd may, with the consent of the Superintendent, create districts for the purpose of conducting sales; for receiving applications for land, and for generally carrying into effect the provisions of the Act. The salaries of such officers shall bo psiid out pi revenues appropriated for the purpose- by the Provincial' Council. All the routine business .relating to the disposal of Waste Lands shall be transacted by the' Cotnoiissionor -of Crown Larfdß, subject to such instructions as he* may receive 'from the Board. -Every dispute and difference-relating to the sale, letting, disposal/and occupation of Waste^Lan'da, or to anything done under tbe Aot,shall beheardand determined by the' Board. - • ! i The Board 'm«y charge a~fe'e not-ex-ceedin<j five pound^ ffbr-th6 vdecision of any disputed question ; the fes' to be paid by the party aiainst whom -the decision, shall be made. All town lands, execpt as otherwise provided^ shall be sold by auction and the upsefe price of the allotments shajl be fix,ed,by the Board, in the case of sections, -however, -which, -having; been put , up- for. sale, have .either been, witb1 drawA or have .not been, sold, the ..purchasers nave, tailed to complete their pu rchases, the, Board may sell such 'sections, otherwise than by auction. In special cases, where persons 6eing in duly authorised temporary occu'patjon of tpwn Ihujlls shall apply to ;_be' allowed to purchase such ? lands» the Board may, with the approval of tjie Superiuteiident'and Provincial Council, sell town land, except .land witfuu the' limits of the towns of Dunedin and Port Chalmers, without exposing the same to auction. AUCTIONS OF TOWN AND SUBURBAN LAND. shall be given of any intended auction of town lands through the medium of the Provincial Gazette, or a newspaper published in the Province, not moro than three months, nor les< than. one month, before such auction shall take place. , > No town land .shall be sold, by auction unless previously surveyed. - The laud, shall be offered for sale by auction by some person to be appointed for that purpose by the Board, who, if an officer of the Board, shall not bo required to tako out au auctioneer's licence. The purchaser shall pay one-tenth part of the purchase, money at the time ■ of sale, and the remaining nine-tenths shall be paid within one month of the date of sale, otherwise the" deposit money shall be forfeited, and the sale be null and void. All suburban lands shall do offered Par sale by auction in sections, the size or extent and upset price of which shall be r fixed and determined by the Board, Subject fro the approval 'of the Superintendent, and subject al«o to the provisions affecting town lands. SALES OF KUBA.L LANDS. All rural lands shall hereafter he. open for sale or disposal, except such as at tho' t'imo application is made are lawfully occupied or reserved.
