(Before His Honor Judge Gray.) Tuesday, August 13.
M'KeUar v, M ( Lelland.— Action to recover £L6B, and |interest, on an implied covenant for payment in a mortgage deed. Mr. Mouat for plaintiff; Mr. Copland for defendant. A set-off, part of which was admitted by plaintiff, was pleaded. After plaintiff had given evidence, his Honor suggested that the parties should arrange the matter, pointing out to defendant, as regarded the remainder of the set-off, it was no answer in law to plaintiff's demand. ' The parties ultimately agreed to a settlement. Judgment was entered up in accordance with the agreement.
