RESIDENT MAGISTRATE'S COURT, LA WRENCE.
(Before Vincent Pyke, Esq., R.M.) Thubsday, March 21. Harris v. Leech. — Plaintiff did not appear, and the case was struck out. Mr. Copland who appeared for defendant, applied for professional costs, £1 Is., which were allowed. Monday, March 25. Fitzgerald v. Cusack. — Claim for £13. Mr. Gooday appeared for plaintiff, and Mr. M't'oy for defendant. Mr. M'Coy asked for a non-suit, as the particulars were not set forth in accordance with the Resident Magistrate's Act, but the Magistrate refused to grant it. It appeared that the plaintiff had brought an action against defendant which was to have been heard the previous Thursday, but was settled out of Court by defendant giving an order on his mate for the amount sued for. The party on whom the order was given refused to recognise it, and the present case was brought to recover the amount The defendant acknowledged having given the order on his mate. Judgment was given for the plaintiff for the amount claimed, with costs.
