(Fief ore W. L. Simpson, Esq., R.M ) Monday', December 4. Hays v. K&ppd. — Claim, £14 6s. for wages. -The sum of £6 His was paid info Court. Mr. Keppel pleaded a set-off for the balance for damages occasioned by Hays to a cart while in his employ. Mr. Copland for plaintiff, and Mr. M'Coy for defendant. Mr. Copland objected to the set-off, and contended that a set- oft' of the nature of the one now pleaded could not be placed against wages. Mr. M'Coy contended that the set-off was a very proper one. The F>ench stated that a set-off must be of the same naturj as tUe claim against which it is pleaded. lie would, grant an adjournment until Thursday, to enable the defendant to place his claim properly before the Court, meantime he would grant judgment for the amount with costs, execution, however, not to be issued before Saturday. Manlmll v. Kitto. — Plaintiff in this case sued defendant for maintenance for her illegitimate child, he being the alleged father. Mr. M'Coy appeared for defendant. The plaintiff, from iii ability to pay, had no solicitor. The Bench remarked that it would be a pifcy that the plaintiff should suffer in consequence, upon which Mr. Copland volunteered his services, and aslcecl for an adjournment for a half an hour to enable him to get the facts. The Court having again sat, the learned gentleman asked for a fnrther adjournment until Thursday, that he might be enabled to get thoroughly acquainted with the caac. — Granted.
