(Before \V. L. Simpson, Esq., Warden.) Wednesday, 29th Nov. Casey Bros. v. Morrison mid party and Nicoii and party, — 'I he evidence iv this case was given last week. Tlie Warden gave judgment as follows :— The whole case resolved itself into this : Were the defendants exercising their rights within reasonable bounds I Ife was of opinion that they were not. Hut tha damages claimed by plaintiffs were excessive, as two-thirds of the claim had been worked. He woidd, under the circumstances, allow only from Llo to 1-20, to constrnct a tail race for the plaintiffs, equally good with their present one. lie expressed a hope that some of the parties' would nppeal fioin his decision, as he was convinced it would not satisfy the parties.
