WARDEN'S COURT.

Wednesday, 19th July.
Thefollowingapplications were granted: — James Lindsay, to construct a dam.' William Simmonds, and James Manly to construct a tail race. Ah Hook and party, to construct a tail race. William Duff, Waitahuna, residence area. Cornelius Guruion, attended claim. Foiig Chow and Ah Laing, extended claim. S. Abrim, P. Crawford, T. Gilmore and Hunter, extended claim. Application was refused to Patrick Tracey for an abandoned race, situate at Munroa.
Thursday, July 20th.
Judgment was given in the trespass case of Harris and Morrison v. Labes, Molzo, Lewis and wife.
Mr. Copland appeared for plaintiffs, and Mr. M'Coy for defendants.
These parties have been so often before the Court that it is unnecessary to give the evidence in full. One of the defendants had worked out an ordinary claim within the extended claim granted and now belonging to the plaintiffs. This action was consequently brought to recover damages against the defendants for injury sustained, and to prevent them from persistently working the-Aanie. The Warden's judgment w^ill sufficiently explain and show the result as follows :—
I find that the defendants, William Labes, James Mulzo, .David Lewis, and Mrs. Lewis did unlawfully enter upon the A claim held by the complainants, and did ; drive thereon to the injury of the eomplainanta, the amount «£ damage is hereby assessed at £5 ; £3 6s. costs of Court, and £26 15s. for professional, costs and expenses ; and the . defendants were further ordered to remove themselves and tools from off complainants' ground. The contra action . brought by the defendants against the plaintiffs was tdlowed to be withdrawn upon payment of £1, Is. COatS. ' . • ...";<i
