WARDEN'S COUET.

(Before W. L. Simpson, Esq., Warden.) Monday, March 20. Stapleton v. Ah Quia. — Damages, LlO. Mr. Gooday appeared for the defendant. It appears in this case that the plaintiff had a claim on the Tuapeka Flat ; that the defendants had constructed a dam on the Tuapeka Creole, thereby forcing the water into plaintiffs claim. The plaint. ff being ex.unined and crossexamined, it appeared that the damages sought to be recovered were excessive. The Warden stated that he would give the plaintiff L 3 and costs, but the opposite party was desirous that the Warden should visit the ground, which he did. On returning, verdict was given for L 3 and costs of Court.
