NOTIFICATION, THE undermentioned application was made to me, under the XIV. Regulation of the Otago Goldfields Rules and^^ Regulations, for the use of the natural channel of Gabriels Gully,, for the distance therein specified, as a main tail* race, subject to the undermentioned conditions. A hearing of all parties interested in said application took place on the 23rd day of November current, at which it was decided to grant the application, which was accordingly done, and the conditions approved of by me. We, the undersigned, being a majority in number of persons from whose claims water or tailings flow to a common outlet at Blue Spur, Gabriels Gully, hereby make application for a main tail-race, commencing at the head of Gabriels Gully at a point opposite the i*esidence of Mr. Hill, and terminating at Lawrence, Gabriels Gully. And we declare the following particulars to be true in every respect : — The length of such race is three mile 3or thereabouts. The average depth is the present bed of the Gully. That no artificial construction will be made to form this tail-race, but that the gully will be used in its natural state as a main tail-race. 2nd. That existing rights will not bs affected by the creation of the gully into a, main tail-race. 3rd. Any person or persons may take up and work ground in the tail-race on condition that such person or persons' shall not claim any condensation for damage done to their workings by tailings or water flowing into or down the race. 4th. Any person or persons may use the main-tail race, and construct head or tail races within the area specified on condition that they shall not claim any compensation for damage done to such head or tail races by tailings or water flowing into or clown the main tail-race. sth. In any case where it may be necessary to determine the width of the main tail-race by measurement, the starting point shall be from pegs that have been placed in the western bank of Gabriels Gully measuring due east. The following measurement to be the average width of tail-race at different points : — From starting point at llenben Hill's l'esidence to Hales' garden, an average width of three chains ; from Hales' garden to Rocky Point, an average width of six chains ; and from Rocky Point to termination at Lawrence town boundary, an average breadth of four chains. WE hereby give notice that we have this day applied to the Warden for a lease of land for agricultural purposes, situate at and being section 21, block X., Waitahuna East, and section 3, block XL, Table Hill, comprising 60 acres, or thereabout" ; and that the said application will be heard at the Warden's Office, Lawrence, on Thursday, 12th January.
