Blmidell v. Taborn. — Plaintiff sued defendant for damages sustained by him in consequence of defendant cutting away hi? water-race at Clarks Flat, and using the water for his own purposes. Mr. Gooday appeared for defendant. From certificates produced in Court, it appeared that defendant had a right to the disputed race three weeks before tho plaintiff had acquired any title, and, therefore, verdict was given for che defendant with c^sts of Court, and 21a. professional costs. Subsequent to the decision, the matter was amicabiy_ arranged between the parties. f ~~
