RESIDENT MAGISTRATE'S COURT, LAWRENCE.
(Before W. L. Simpson, Esq., R.M.) Thursday, May 26. Thomas Jeffreys v. Cousins. — Cousins was charged with being illegally on the premises of plaintiff on the evening of Saturday 21st inst. The evidence of plaintiff went to show that he found defendant on his premises about dusk on Saturday evening, and as he had on mauy occasions lost valuable articles, he ordered Cousins off the ground, which he refused to do. Cousins provided a witness (Reuben Hill, jun.) who swore that he saw Cousins on the premises of plaintiff, that he had gone there to lake a duck, his property, out of a hole ; that he heard plaintiff abuse Cousins in very gross language When Cousins got the duck he left the plaintiff's premises. Defendant said that on the evening in question he went to take a duck, his property, out of a hole, that whilst doing so Jeffreys came to him with a stick in his hands and abused him. When he got the duck he left, and Jeffreys again began to abuse him in language anything but respectable. This olosed the evidence. The Magistrate remarked that this case was bronglit before him under the Vagrant Act, and from the evidence adduced he could not find any felonious intent on the part of the accused. As he was merely getting his own property out of a hole in plaintiff's ground, he had therefore no alternative under the circumstances but dismiss the case. He would allow no expenses on either side. Gibb. — Adjourned for one week to enable plaintiff to produce the party who sold the goods to defendants.
