WARDEN'S COURT.
(Before W. L. Simpson, Esq., Warden.)
Cousins, Earrel, and others v. M'Nab and party,— Claim £30, for damages sustained to plaintiffs in consequence of defendants, by their workings carrying away, and otherwise destroying their race on 25th of May last. Mr. Mouat for plaintiff; Mr. Keen for defendant. The evidence, as usual in such cases, was of a conflicting character. The Warden reserved judgement until he gave the ground a personal inspection. Casey v. Morrison and others. — Claim £80, for damages sustained in consequence of defendants depositing sludge and tailings on plaintiff's claim and tail race. The plaintiff being desirous of having assessors, they were duly summoned, and proceded to the ground. On their return the case was gone into. After the evidence was heard, the jury returned and found for the defendants ; plaintiff to pay the costs of assessors and costs of court. No expense for witnesses allowed.
