Neave'v. "Fitzgerald. — Xeave charged. Fitzgerald with having, on 25th April last, assaulted him by striking him on the mouth.

Mr. TI. C. Uicliards appeared for plaintiff. ;

The evidence of the plaintiff went to show'that'he had engaged wiih defendant during harvest time for 275. Gd. and found, .and that defendant endeavoured to get him i,o sign a paper for 2os. per week ; on the refusal of the plaintiff, that Fitzgerald took hold of him by the throat and struck him on the:mouth.

Mr. Fitzgerald, being sworn, deposed contrary to {he plaintiff. lie said that he had engaged him for only three weeks at 275. 6d., and the remainder of the period for 255. It appeared from the evidence of the defendant that the plaintiff made a large demand on a certain vocabulary, which will be nameless, and which is more expressive and redolent of expletives than common decency will endorse or warrant publication. Charge dismissed "oh r the ground of no "proof. His Worship remarked that lie was surprised that such cases, unsupported by, proof, 'should be 'brought before the Court. , , ' P Herbert and Co. v. Mcc. — Claim, £2_l2s, 6d., for goods sold and delivered. r Judgment for amount. An immediate .execution was asked for. ' Pearson v. Hunter. — This was an adjourned case, in which, plaintiff 'claimed £5 for damages done by cattle Mr. Eiehards for plain- 1 itiff; Mr. Keen for defendant.. Tlie evidence for plaintiff went to show ."that defendant's cattle were repeatedly in his paddock, and . that he had to go >up frequently at night and drive them away f ; that no other cattle than those ,of defendant's had done any damage. The evjdenee for the defence went to prove that other cattle than those of defendant's were seen in the plaintiff's 'paddock/; tbafrjhis own cattle had been seen amongst his crops "many timesmore particularly a bull, the property of plaintiff, f Verdict for plaintiff, £2, and. costs of Court.
