In re application of Ah Lin for permission, to mine on agricultural leaso area in the occupation of Thomas Darton. Mr. Darton opposed the application on the ground — Firstly, that having laid* down hi 3 lease at great expense in English grasses, their working would destroy his property ; and secondly, that when the mining laws were framed, it never was contemplated that their lands should be prostituted by the foot of aliens. His Worship remarked that he must be aware that, in accepting .his lease, he (defendant) had undertaken certain covenants, and one of these covenants was the right reserved by the Crown of ingress and egress in search of gold; and again, as long aa the Government issued miners' rights, he was bound to see that the aliens had equal rights -with the natives of the soil.
