WARDEN'S COURT.

(Before W. L. Simpson, Esq., Warden.)

W. D. Morrison and party, some considerable time ago, purchased off Spiers and party their right to a mining lease issued to the said Spiers and party (which lease was never executed). On the Bth of December last, he made an application in his own name to the Warden for a lease of said piece of ground. .Several objectors, holders of water races, whose races pass through the ground* objected to his application unless their rights'were secured. After a lengthy discussion, the matter was. mutually agreed upon as follows :— -Mr. ' Morrison.agreed to accept the lease subject to the rights of present raceholders ; but they were not to be allowed to come nearer his working face than at present, and that at any time when the ground can be worked, Morrison and party, or their assignees, are to have the sole right to work the said ground specified.in the lease. • . The .objectors had no objections to his having his lease if their rights were duly protected. They never had any intention of working the ground. The Warden remarked that he would recommend the Government to insert in -the. lease a clause embodying the conclu-sions-arrived at. He further stated that Morrison must apply for a cancellation of the old lease, for the Government could not grant the same piece cf ground to two parties. He further remarked that he had written the Government on this, subject (read the letter), but received no reply.
