WARDEN'S COURT.

(Before W. L. Simpson, Esq., R.M.j Mojs jdat, 23rd Nov. Schotel y. Lancaster. — E. Schotel charged Lancaster with having on the 20th October last depastured thirty head of great cattle on lease 'of Schotel Brothera, said ran being No. 178. Defendant pleaded- not guilty. George "Williams deposed to having seen Lancaster on the above date driving about thirty head -of cattle before him. He was- about, three or four yards beyond the boundary line which divides Schotel's run from the 2500 acres taken off said run for agricultural purposes. He stated that he knew the direction of the line becanse j\lr. Shanks, the surveyor, pointed the same out to him.. When he saw Lancaster he was a quarter of a mile distant. In the lot he noticed ten of the cattlo as belonging to Lancaster. There were many cattle in the district other than Lancaster's. He himself had sold cattle for Lancaster with his brand on them. David Hunter deposed that he was driving cattle with Lancaster on that day. Did c o !; know the boundary line. Mr. Nicholson, surveyor, produced map and plans showing approximately the position of the line. " G-azette," &c, having been examined, the Warden, after summing up, gave credit for seventeen head as belonging to others, and fined Lancaster ss. a head for the remainder, costs of Court, and expenses. Same v. Same. — Lancaster waa charged with having on the 28th October last depastured forty head of cattle, his property, on the run of Schotel Brothers. Evidence having been adduced at considerable length, the Warden remarked that the evidence was anything but satisfactory,' therefore he would mate no order. " In dismissing the case he remarked to Mr. Schoiel that it would be wise to have the boundary line defined, so as to avoid the difficulty as to boundary.
