Thursday, October, 29. . . ADJOURNED CASE.,, ' Leslie v. M'Phorsbn.— blaim/^2O, for non-delivery "of a cow sold to plaintiff in June last by- Mr. Smith, auctioneer, Cliitha; and expenses in purred in endeavoring to effect a' settlement. The case was adjourned to enable plaintiff Ito c provide the ( ; auctioneer. The evidence in the case was extremely clpudy»,and ;un^atisfactory^, A ,docu-.~ ment in the .shape of receipt,- which threw some light on the subject, was held back, the reason for which was that the document was not stamped. The plaintiff being anxious to' obtain a verdict, elected' to stamp the ■ document, and. pay.' the, ipenalty \of' .ten "pounds as a fine for not having on the document the one penny stamp. After some consideration, the ,yerdict was recorded for plaintiff for £14 and costs of court, no other expenses were allowed although asked for.
O'Neill v. Tulley. This was also an adio^rnedeaseJfbr thelpurpose of pr.oaucmg a carrier oi the name or Gillespie, to prove delivery of a , barrel pf beer. There being no' appearance of plaintiff, case was dismissed, plaintiff to pay defendant ten shillings as expenses.
