Action was brought by tha Public Trustee 1, the administration of the 'estate of Cfeiarlotte Cash, of Hielensville, Ajuckland. Uast Dtecemlber Mrs Oa^h Was murdered! iby her 1 husband, who was triedl at Auckland, found guilty ol wilful murder and sentenced to death, the sentence being 1 ■ sut-se-quiently. colmlmu-ted to, imprisonment for life. Mrs Cash died' intestate and the administration of ker estate was granted to the Publici' Trustee. She left no issue andl undei' the oiidinary circiumsitancesi her 1 estate would! have gone toi her husband.
The question has now airisein whethei' the policy of law would, allow any benefit toaccure to a, criminal by his cnvn net; in other words, should! the murderer inherit his victim's propierty?
Three cases wtere memtioned by the counsel for the PiiMio Trustee! in his argument—<namely, Fauntelroy's case in IS'2's, Mrs Mayibrick's case in 1890. and Noi'a Oiippen'si ease in March last. : : ■.
