RESIDENT MAGISTRATE'S COURT.
THIS DAY. (Before H. Kenrick, Esq., R.M.) seaman's wages;
. Thomas Holmes, master of the schooner Awaroa, was sued by Robt. Saunders for £6 16s 8d wages.
The defendant admitted the liability, but said that he objected to pay the man off, as he could not get another man here.
The plaintiff swore that he had signed no articles; he had engaged with the defendant merely verbally at £5 per month.
Robert Kcrr, cook on board, deposed to hearing the captain promise to discharge plaintiff as soon as the cargo was out. The captain did say something abcrci having to got. another man.
•r ". . Captain swore that be was agreeable to pay the money, but did not want to discharge him till, ho got another man in his place. He was engaged by the month, but his month was up while the vessel was at sea.
Judgment was given for the amount claimed aud costs, 9s.
