THIS DAY. (Before H. Kenrick, Esq., E.M.) CIVIL SIDE. JUDGMENT FOE PLAINTIFF 3. Crocker v. Bullen.—Claim, £1 16s, for ■goods sold ; costs, Bs. Fagg, v. Swift.—-Claim, £7, for rent; costs, lls. Whitehead v. Bants.—Claim, £9, for goods sold ; costs, lls. Defended Cases, taipabi v. bickits and others. Mr Miller appeared for plaintiff. The plaintiff proceeded for damages on account of trespass on his land on the Karaka Creek. It appeared that defendants had been quarrying on land ' claimed by Taipari, which it was contended could not be' used except for gold mining purposes, without theconsentof the native owners. A witness stated that permission had been obtained by the employers of those who had removed the stone from the County Council to.quarry where they did. Taipari denied having given per- I mission to the defendants to remove the stone, and stated that the land from which it was taken was owned by himself and his wife and daughter. The stone was worth 3s a load. One of the defendants swore that the permission given by the County was to widen the road where the rock was removed from, and he could not throw the stone into the creek adjoining, or it would have blocked it, consequently it was carted away andused on the railway contract. The Bench held that Kickits was a servant of Gordon and Bobinson, and struck out his name; the remaining defendants were Gordon and Kobinson, railway contractors, and Wilson. The case was adjourned until next Court day for the purpose of obtaining the evidence of the County Surveyor as to the permis* sion given by the Council. Adjoubned Case. MOEWICK V. CBIBB. On the application of Mr Miller, for the plaintiff, this case was adjourned for 14 days. Judgment Summons. J. A. Miller y. B. C. Fryer.—Claim, £2 18s 26. Owing to some irregularity in the service of the summons, the proceedings were withdrawn.
