IN BANKRUPTCY. /• _> (Before His Honor. H. G. Seth Smith, . District-Judge.) ' , In re Sherlock Bros, (debtors). George Sherlock was examined by Mr Miller, who appeared on behalf of tbe debtors, and stated that the bankruptcy was due to.bad debts and general inability to collect book debts. The liabilities were stated at £366, and the assets £400. Believed the estate would realise 20a in the pound. The boiling-down establish.* ment at Parawai is owned by his father ; the firm had' no interest in it. Everything belonging to the bankrupts had been given up.—W. J. and A. Sherlock gave corroborative evidence. —The Deputy Assignee (Mr W. Carpenter) expressed himself satisfied with the statements made. —The next Court day was fixed a£ the date upon which an application for'discharge could be made. "" .
In re Thomas Caldwell, a debtor.
Mr Lush appeared for the bankrupt. —Thomas Caldwell, sworn, stated that the cause of his bankruptcy was through his having taken the lease of a dairy from Gould Bros., and in consequence of a breach of agreement on their part, and losses consequent on having lost a lawsuit over the breach, and having to pay the costs of the action and a subsequent arbitration; in addition to which he had sustained various losses on his last two dairy farms. He would have been able to have met his creditors satisfactorily, as the present season promised to turn out a good one, had not certain of his creditors pushed him into the Court by suing him. There was a bill of sale in existence given by the debtor to Messrs Carr and Son, and assigned by him to Messrs Wells and Soutter. Had given up.all his property. — la answer to Mr Carpenter—when he gave the bill of sale he was not aware that it covered after-acquired property. Owed Carr's estate about £157. The value of the assets, after paying Carr's claim, would be nothing. The total liabilitiesamounted to ,£443.-—By consent of j" the Deputy Assignee, it was agreed- that His Honor should have.a case.submitted to him next Court day as to directions re proceedings in connection with the bill ot'sale mentioned. The examination of the bankrupt was adjourned until next Court day for such a purpose. .7 v
