An important commercial decision was given by Judge Williams in banco to day. Prior to 1879, if a debtor was adjudicated a bankrupt on a creditor's petition, the title of the trustee related back to any act of bankruptcy for which the debtor was capable of being adjudicated a bankrupt. In the session of 1879, Mr W. D. Stewart obtained an amendment of the Bank ruptcy Act, by which the title of a trustee when a debtor filed a declaration of insolvency related back in the same manner as if a debtor had been adjudicated a bankrupt on a creditor's petition. Mr Denniston, for the holder of the bill of sale in the case under notice, contended the Act had not this effect, but the judgment holds the contrary. It is understood that the Chief Justice and Judge Bichmond hold the same view as Judge Williams.
