GOLD SHIPMENT,

The Bank cf New Zealand shipped 241402s gold- for Auckland by the Kotomahaua this afternoon.

WARDEN'S COURT.—This Day. (Before H. Kenrick, Esq., Warden.) KELLY V. WALKEB. This case was adjourned from last Friday in order to procure the evidence of Sergt. liussell.

Mr Miller appeared for the defendant, and Mr Cuff for the plaintiff. . Sergt. Russell, being sworn, said he was Clerk of the Resident Magistrates' Court, and acting clerk of the Warden's Court, Paeroa. He received monies for miners' right, and gave receipts for the same. Mr Kelly gave him a pound for a miners' right, and lie Kelly a certificate, on the 28th September. He signed an abandonment of the Eclipse claim. He gave the notice immediately immediately he had received his miners' right. To Mr Miller—This was the book in which he entered documents when he received them. He believed he made the entry referred to at the time it was received. He could not account for the fact that the entry of October 4th was piit in the book before September 28th. He usually sent the money down imtne diately he received it. He wroe the notice of absmdonraeut of the Eclipse claim on the day he «aye the receipt for the miner's right. He held no iuterest in the Surprise claim, and had not been promised a share. To Mr Cuff—He was quite clear that the money was paid on the 28th. Mr Kelly must be mistaken as to the date. He saw Mr Walker at Paeroa on the sth October. In answer to a question of Mr Walker he said that the Eclipse had been abandoned.

Mr Thomas Shaw deposed that he had abandoned the claim en the 28th September. He cut the lines round the claim, so that Mr Bayldon could have no difficulty in making the survey. After hearing further evidence; His Worship disallowed the objection. Court adjourned.
