WARDEN'S COURT.

THIS DAT.

(Before H. Kenrick, .Esq., Warden.) S. MPBPOCK V. J. MOBTON AND OTHEBS. This case which was adjourned last week to enable plaintiff to prove the pegging out, &c, was called on.. Mr Brassey appeared for the plaintiff. Mr Cuff drew the 1 attention of the Court to the fact that the ground in question had already been awarded in case of Nicholl v. Smythe, and he had the order of the Court in his hand.

Jeffry Morton, deposed that he was one of two who had pegged out the ground, the Bright Smile, Waihi, on the 25th of April, 1831 At. the time the claim was registered, he did not know its correct area. (The ground was then pointed out on a plan put into Court.) ; Neither he nor his mates had worked the ground, but he had not abandoned it. He would have no interest in the claim' had it been awarded' to .the plaintiff. The Little Tommy was pegged off the day before the Bright Smile. ,

Francis Creighton, one of the plain* tiffs, gave corroborative evidence. A mistake was made fin describing the boundaries when the claim was registered, "Young "Colonial being inserted instead of "Old " Colonial, but this was rectified before, the Court seal was /attached to it; He had applied for a license for a claim which took in & part (about two* men's ground) of the Bright Smile ground. _ His Worship reserved" judgment till the hearing of the objection to the grant* ing of a license for the same piece of ground, as the Traiwit Jfufyfi ment would be given |pn the. 11th^ovenar C. Mr Miller appeared for the plaintiff, and Mr Cuff for defendants. Mr Guff applied for an adjournment, on the ground that! he required tbe presence of a material witness before he could go on with his case. Mr Miller objected,; but the application was finally granted, 1 the case being adjourned to the 20th~inst., defendants to pay the costs. } Court adjourned till 3 o'clock.
