DISTRICT COURT.-This Day.

(Before Judge Macdonald.) MCIIHONE V.. MEEIMANA KONUI. Claim, £21, amount of an 1.0. U. Mr Brassey for plaintiff, and Mr Miller for defendant.

Mr Kenrick, who.had been subpwnsed as a witness in this case, asked His Honor's ruling as to whether he could be compelled to give evidence/and to produce his notes. He could not well attend, as he had to leave by the steamer at eleven o'clock.

Mr Brassey said he did not subp«oa Mr Kenrick merely to produce his notes, but to corroborate the evidence given in the It.M. Court should any of the witnesses swear differently today.

His .Honor said he could not rule against the subpoena, but ho would say that if the case appeared to go against Mr Brassey, owing to Mr Kennck's absence, he (the Judge) would see that Mr Brassey's case did not suffer from it.

Before the jury were empannelled, Mr Miller objected to the case proceeding, on the ground of no further particulars having been given.

His Honor overruled the objection, and said the proper time for Mr Miller to object was when the particulars were sworn to. .

The following jury were then empannelled :—Charles Ahier, Saml. Alexander, George Basham, and James Allen, of whom Mr Allen was elected foreman.

The evidence was the same as that given before the Resident Magistrate, some few other particulars being given.

Judgment was given for £12 ss, but without costs.
