WARDEN'S COURT.
THIS DAY,
(Before H. Kenrick, Esq., Warden.) F. CREIGHTON V. G. MOBTON AND PARTY. This was a plaint against the defendants for the non-working of the Overland Claim, at Waitete, wherefore complainant prayed to be placed in possession. Defendants did not appear, and there was no return of service of summons.
Mr Miller said he appeared for neither complainant or defendant, but for the bona fide owners of the ground. McCombie and party, who had also been working the ground. Morton and party had given notice of pegging out, but had never pegged and had done nothing on the ground. McCombie took it up and worked it, and having struck gold the present action was taken to validate the bad title to the ground of Morton and party. '
His Worship could not go on with the case owiDg to their being no proof of service of summons, consequently the case was adjourned till May sth. J. LANTON V. MOBROW AND GAGE. This was a plaint against the defendants, who owned the Norwich Claim, Te Papa Gully,;;for non-working, wherefore the complainant prayed that the ground be forfeited, and he himself placed in possession. Complainant proved that Gage had not been working his share for six months. Morrow had been working. His Worship declared the claim forfeited, and ordered Lanton and Morrow to be placed in possession, giving costs against Gage. Court adjourned.
