CIVIL SIDE.

(Before Harry Kenriek, Esq., 8.M., and T. L. Murray, Esq., J.P.) INTEEPLEADEB.

This was a case in which execution was taken out under a judgment of the B.M. ■Court in the case of Francis McOormick v. Frederick Jackson, recently heard, and a mare was seized by the bailiff under a warrant of distress, and which animal the applicant, B. Wills, claimed as his property.

Mr Dodd appeared for the claimant, and Mr Miller for the execution creditor.

Bobert Wills, sworn, said—He was a settler residing at Tapu. He knew Mr FrederieiF'Sfackson, from whom he bought the mare now in dispute, and gave me an order from it on the 17th January. He instructed Mr Jackson to lake the horse to Bickets' stable. The mare became his property on the date of the order. Mr Jackson obeyed his order and iook it to Mr Bickets. The mare is his properly. To Mr Miller—Witness, was a carter, driving for Mr Hawkes.- He had no other horse at present. He sold the last two years ago. He worked by contract. The last coniract was for carding shingles. They had a settling up at Christmas. He told Jackson to sell mare, but he was not to take less than £13 or £14.

Frederick Jackson said he resided at Tapu. He knew the mare in dispute, which was the property of Eobert Wills. He received an order from Mr Wills which was paid by Mr Hawkes. He bought the mare from Mr Brokenshire. The mare belongs to Mr Wills.

After hearing other evidence, the Court ordered the mare (o be given up to Mr Wills, and each party to pay their own costs.

Court adjourned
