Edward Rodgers was «bar#ed wjth a breach of tlie bye-laws by driring on the wrong side of the road, and refusing to give way. Mr Miller for complainant, Mr Brassey for the defendant. ,
JVB. Mbeod, the complainant, deposed that he was the inspector of rehicles, and knew both parties concerned. Thomas Godkin, deposed—He remembered being with his cab on the Tararu Road on Wednesday night last after 8 o'clock, was immediately behind Kodger's cab, and had six passengers. It was nearly opposite the Moana'airi battery. The defendant was on the right hand side of the road. The defendant when hailed asked what was wanted, bat did not more ont of the way nor did he do so till both cabs arrived in town. There was nothing to prevent defendant from giving room for witness' carriage to pass. By Mr Brassey—Capt. Fraser, and C. Short were on the box seat with witness. There was plenty of room on the near side to pass. There is no ill-feeling between witness and defendant. Believed defendant wilfully obstructed the road. Was behind Sodger's cab quite close. C. Short deposed—He was on Godkin's. cab on the night in question. When their cab got up to Rodgers' Godkin called out. There was not room for Godkin to pass oh his proper side while Rodgers kept where be was. Godkin kept up to Rodgers pretty close, fiodgers went away at a greater pace as soon as he was hailed. If Godkin had driren faster than Rodgers he could hare passed him on his proper side. Where the cabs first approached each other there was a heap of stone on the road whioh would prevent a cab passing just there. There did not seem to be any inclination on the part of either driver to pass each other, as both were driving at a good brisk pace. By Mr Brassey—The passengers in either cab were not in danger from any i collision after the first meeting of the cabs. Rodgers was going at too brisk a pace for Godkin to pass him. There, was no delay caused Godkin. The Court dismissed the case. Court adjourned.
