Waitakerei, and threatening to kill him on the 16th inst.—Mr Theo. Cooper appeared for defendant and pleaded not guilty. Mr Tyler appeared for complainant.—This case created a great amount of interest, and the court was crowded by workmen. The complainant deposed to a most brutal attack beinjj committed on him by the defendant. He gave no provocation. Danahar struck him in a most brutal manner and even kicked and beat him when he was " down."—-Edmund Morgan deposed to the assault, which was a most disgraceful one.—Mr Theo. Cooper addressed the Court in defence, and claimed that the defendant was provoked but that instead of boating the complainant, he had only -, pushed him away from the tunnel, where the alleged assault occurred. His Worship (R. C. Barstow, Esq.,) considered the charge fully proved, eveu upon defendant's own confession, and ordered him to pay a fine of £4 10s, costs £5 10s, and to find sureties to keep the peace for six months, himself in £50, and two sureties in £25 each.
