RESIDENT MAGISTRATE'S COURT

(Before H. Kenrick, Esq., E.M.) DOG NUIBANCE ACT.
James Porier was charged with al'o-rig his dog to be at large without a col,. ■
The accused explained tiat lie v.a ; not in circumstances to pay for a collar. Tbe Bench explained the law upon the subject, stating that the law was most explicit upon this matf ?r, and that theye was no discretionary power in the hands of the Bench or the police. tTnder the circumstances the Court would inflict a fine of one shilling without costs.
Mr Carrol for a similar offence was fioed in a like amount.
Grorge Fisher failed to appear pnd not having registered his dog was fined 10s and costs.
John Rafferty was fined 5s and costs, his dog being registered in the meantime.
THE SAFE CASE,
His Worship said tbat having con" sider'-d the application of Mr Brassey that the accused be allowed bail, he had decided not to grant the application. assault. . Patrick Lawlor was charged that he did unlawfully assault a certain male person, to wit, one Henry Forman at Tairua on the 11th June. Mr Brasssy defended. .Henry Forman said he lived at Tairua with accused and worked at the sawmill. On the [evening of the 11th he went to bed at 10 o'clock, and was awakened* some hours afterwards by accused, who tben committed an assault on him. (The evidence was here unfit for publication) The next day witness asked accused if he intend'd o clear out of the house, and he said, " I'll clear." Witness then said he would" tell the manager. On the following Sunday wiiness told Constable Joyce of what had occurred.
Cross-examined by Mr Brassey: He laid the information, and krew that the assault was a very grave one. Accused was not an abstainer, and had severe 1 times came into the shanty in a state of semi-intoxication. He was so frightened after the assault that he did not caU out. He did not wake O'Keefe. He could not say how O'Keefe was lying, his clothes were wrapped all round him. The witness was subjected to lengthy cross-examination, by both Mr Brassey and Sub-Inspector Kenny, and he was still being cross-exumined when we went
to press.
