RESIDENT MAGISTRATE'S COURT
THIS DAY/,, (Before E. P. Tizard and Major Murray, Esqs., J.P.'s.) A STOEM IN A TEA-POT. Richard Cailey was charged with illegally making use of abusive language towards Michael Donnelly, thereby endangeriug the public peace. Mr Brassey appeared for the defendant and pleaded not guilty. He drew the attention of the Bench to the fact that the words complained of were not set forth on the information. He thought it was unfair to his client, as he hfd to meet a charge he knew nothing of. He would ask for an adjournment in order to obtain fresh information with the words complained of set forth. He had only been recently instructed, but he understood that abusive language had been made use of on the part of the plaintiff quite as calculated to cause a breach of the peace as that alleged to have been used by the defendant. The Bench said they would grant an adjournment for a week. Mr .Brassey asked the Court to adjourn the case until this afternoon. The Bench said that perhaps it would be as well to go on with the case, and they could then see how the error affected the case. . Mr B'assey asked whether if they went on with the case, an adjournment would be granted P The Bench decided to adjourn the case for a week. Mr Brasaey said they would be willing to go on with the oase if the Bench acquiesced. * The Bench:—The rase is adjourned until the 23th inst., and ia the meantime the plaintiff will amend his information. At the conclusion of the case the Bench remarked that the information was thoroughly legal, as it did not require the words alleged to be made use of la be inserted. However, Mr Brassey wanted time, and they consequently adjourned the case. ' ■ ... . '. ' ■ ■ '•"■ , Court adjourned.
