(Before Dr Kilgour, Esq., J.P.) A MISTAKEN NOTION. , John Power was brought up on two charges, viz.:—lst, of committing an assault on Dr Payne, in Augustus street, on May the Btb, by taking hold of the bridle of his horse; and, secondly, of using abusive language to Dr Payne, whereby the public peace was endangered. * , Mr Miller appeared for the plaintiff, and Mr Brassey for the defendant. This case arose out of some mistaken ideas of the defendant. Ho- was under the impression that he could remove an. obstruction without asking for aid from the police. On the Bth of May the plaintiff was paying a visit to a patient in Augusta street, and had occasion to leave bis horse on the footpath. The defendant came by and laid hands on the bridle of the' horse. He also used abusive language to the plaintiff, and nearly provoked a breach of the peace. Mr Brassey said he had been instructed by his client to say that he was extremely sorry for his mistake, which had arisen out of erroneous notions of possessing authority. He wished to tender a complete apology to Dr Payne for his conduct. Mr Mi!iei' said he was quite willing to accept fhe apology. Tne case was then withdrawn.
