Thames Borough. Council.

The adjourned special meeting of the Council to consider the Water Supply deed was held at the Council Chambers yesterday afternoon. Present—His Worship the Mayor, Crs Wilkinson, McGowan, Wilson, Osborne, . Marshall, Bawden, Graham.

The Mayor in opening the proceedings said he wished to make certain alterations in the deed submitted on the previous day. He did not think it advisable that the County should be permitted to run their water through the Borough pipes. On the*motion of'Cr McGowan the Council then went into committee and sereral alterations were agreed on and the amended deed adopted. The amended document reads as follows:— k

This Deed made the — day of J — 1880 between the Chairman, Councillors, and inhabitants of tbe Thames County (hereinafter called " The County") of tbe one part j and the Mayor, Councillors, and burgesses of the Borough of Thames (hereinafter called " The Borough") of the other part—

Witneeseth that in consideration of the sum of £3500 to be paid by the G-eneral Government of New Zealand to the said County. The said County do hereby assign and transfer unto the said Borough its successors, and assigns, All the right, title, and interest of the said County of in and to all and singular the property and assets of every kind and description whatsoever and wheresoever of and belonging to the Thames Water Supply Committee or in which they may have any estate, right or interest, together with all the rights, easements, and appurtenances thereto belonging, And also all cboses in action, and the benefit of all contracts and engagements made and entered into by the Council, and all rights of representation and all other rights, powers, benefits and advantags which the said Council receive or may exercise or are entitled to under or by virtue of "The Thames Water Supply Act 1876," or otherwise howsoever to hold the premises unto the said Borough its successors and assign absolutely. And this deed further witnesaeth that for the consideration aforesaid the eaid County Council do hereby agree that upon the Race with the water therein, known as the "Thames Water Eace," being legally transferred to and b scorning vested in the said County the eaid County will allow, without other change or compensation, the use by the said Borough,

within the Borough boundaries, of the lastnamed Water Race Supply for all purposes not connected with goldmining or quartz crushing. 1. The nine-inch main of the Domestic Supply at the junction of the two services at Albert street shall be always kept amply supplied with wator from the Thames Hace, whenever required so to be by the Borough Council, and available for immediate use by the said Borough, the valves beirig kept open (excepting at times when repairs are necesBary) And provided always if at any time .the Borough Council shall prefer to construct a reservoir anywhere between Warmoll's land at Parawai and the WaioKuraka for the purpt ?es of storing and filtering the water from the Thames Eaoe before it enters into the mains of the Thames Water Supply or any other mains the Borough may be in occupation or possession of, tae Borough shall be at full liberty te maka a connection with the Thames Race, and draw water therefrom at such place as may be most suitable to supply such Reßervoir, and may connect such Reservoir with the said Thames Race with .pipes not larger than 10 inches in diameter, and upon such connection being so made the Thames County Council shall permit, allow and keep always flowing into such Reservoir ' when required so to do the same quantity of clean, pure water as is hereinbefore agreed to flow into the aforesaid nine-inch mains ! at the junction of Pollen and Albert streets, and the County Council then shall close and keep closed except during fires the valves at the said junction of the said streets, or valves at any other place that may be objected to by the Borough Counoil. 2. That the opening and cloßing of the valves at the junction shall be under the control of the County. > 3. That it is distinctly understood that no water taken from the Thames Race shall be granted or used by the said Borough for goldmining or quartz crushing purposes. 4 Whenever the Domestic Supply shall fall below the actual requirements of those parls of the town which are not connected with the nine-inch main, t then the said' County will supply water to the extent required and subject to the same conditions as hereinbefore provided in respect of the Albert street junction, by permitting the said Borough to connect with the Thames race at a convenient place.

5. That all expense of connection is to be borne..

6. That it is specially understood that all the mains and services belonging to the Domestic Supply are to be kept in thorough good order and repair by the said Borough, so as to prevent waste. 7. If at any time by reason of defects or for other reasons the said County should determine not to repair or renew the 20-inch main now connecting with Albert street and their reservoir, they undertake to connect immediately therefrom with the nearest or other best point on the line of the nine-inch mains belonging to .the Domestic supply south of its present termination ntar the Governor Bo wen Hotel in Owen street, the said County paying the expense of Buch connection.

8. The sole right to supply w»ter for domestic and household purposes within the Parawai, Kauaeranga,. and Waiotahi ridings, as well as within the Borough, is hereby reserved and vested in the Couucil of the Borough of Thames, and the County Council undertake that no water shall be supplied by them from the said Thames Race, or other sources, for suoh purpose within the districts so named unless with consent of the Borough Council.
