MCLEAN V. KELLY.

Claim, £2 3s 3d, land tax. Mr Miller appeared for defendant, and admitted several items. His defence was that defendant was charged for property belonging to another Mr .Robert Kelly. Mr Bodnmn, representing Mr McLean, Land Tax Commissioner, said that the defendant should have objected to his being charged. Notice had been sent to him to afford him an opportunity. His Worship pointed out that the mistake was the fault of the Commissioner and he would have to nonsuit him with costs £1 9s (in addition to the adjourn* mcnt costs, which amounted to £1 195.) Court adjourned.
