RESIDENT MAGISTRATE'S COURT

THIS DAY. (Before H. Kenrick, Esq., R.M.) Wm. Eose was charged with using abusive and insulting language towards J. W. 11. Guilding. This case was adjourned from yesterday, and now the defendant was fined £2 and costs. ALLEGED LAKCENY. Mary Ann Cain was charged by Walter Eatcliffe with having feloniously stolen a certain number of articles of clothing of the value of £8. Mr Miller appeared for the defendant, and stated that she admitted having taken the goods, but denied any felonious intention. Her daughter had married the prosecutor Walter Ratcliffe without her knowbclge, and having heard that she (the defendant) proceeded to Mrs Brownlow's, where her daughter had been staying and demanded the clothes saying she hud the I

Mr Brassey, for the prosecution, said he was willing to accept the explanation made by Mr Miller, and would withdraw the ease with permission of the court upon the clothes being handed to Mr Ratcliffe. His Worship said ifc was quite clear from the explanation given as well as from other circumstances, which had come under his noticp, there could have been no felonious intention on the defendant's part, and he would therefore dismiss the case. As the goods had not been proved to have been stolen, he could only order them to be returned to the defendant from whom they had been taken, and under the search warrant which in his opinion ought not to have been issued.
