Judge Broad delivered judgment in the insurance care of White r. South British. Defendant refused to pay on the ground that plaintiff had effected insurances on the same property in other companies of which he had not giren them notice. White's counsel contended that as the value of the goods destroyed exceeded the total insurances it was not material to inform defendants of other insurances. The Judge ruled that under the express condition of precedent and plaintiff having alleged fulfilment of ail conditions it was

necessary for him to prove compliance with this ono. He quoted a case of an Agricultural Lnnd Company v. Sanders as being strongly in point, and gave judgment for defendant with costs..

Gibbs was declared elected for Collingwood.
