That $he money claimed in plaintiff's declaration was paid to the use of the defendants and not otherwise. -2. That the money had been previously acquired by plaintiff 1 in fraud of his co-partners—to wit, the:general body of shareholders in the Otago Daily Times Company. Argument on the rule will be continued to-morrow.
