McCulloagb, Esqs., J's.P.) ; ASSAULT. : Samuel Dowlan and John Patterson were charged with antulting one Thomas Hcsking on Sunday, the 16th inst. : ■ Mr Miller appeared for defendant!, who pleaded not guilty. / ; j , Thomas Hosking, sworn, deposed—l am a hairdresser, residing at Grahamstown. I remember Sunday, the 16th inst. I saw the defendants in Owen street after they had been in my shop. Dowlan ran after me with my pole in his hand. I ran away. Patterson was running.after Dowlan and said he "would make it . hot for ma before he left town." Patterson was walking after me and I ran across the street. Dowlan ran ten or twelve feet after me. This was about eight o'clock in the morning. By Mr Miller—l ran pretty quick. Dowlan had my pole. I ran across Williamson street. Patterson and Dowlan stopped when I stopped. James Cocking, sworn, deposed—l am a miner living in Grahamstown. I remember the morning of the 16hh. I was in Allaway's dining room at eight o'clock on that morning, and saw the barber run out, followed by Dowlan with the barber's pole, with which he evidently intended to harpoon the barber with. Patterson was following Dowlan, but did hot take any part in it. Dowlan dropped the pole and shaped te fight the barber. This concluded the case, and at this

point Mr Miller submitted there was no case to meet as against Patterson, who was then discharged. Mr Miller said he would now meet the case against Dowlan. John Patterson, sworn, deposed—l was present at this supposed assault. When Hosking got outside the door Dowlan dropped the pole and did not follow. Michael Maher, sworn, gave corroborative evidence, as also did the defendant Dowlan. x Fined Is and costs, or 24 hoars imprisonment. . . .. Court adjourned.
